When a student reaches 18 years of age or attends an institution of postsecondary education at any age, he or she becomes an “eligible student,” and all rights under FERPA transfer from the parent to the student. Your student may provide you access to their education records by completing the FERPA Consent to Release Educational Records, accessible through the MyVPCC portal.
FERPA permits the disclosure of education records, without the consent of the student, if the disclosure meets certain conditions. Parents of an eligible student may receive access to the education records if the student is a dependent per the Internal Revenue Services (IRS) definition. Current year proof of dependency is required. Generally, if either parent has claimed the student as a dependent on the parent’s most recent income tax return, Virginia Peninsula Community College may school disclose the student’s education records to either parent, without the eligible student’s consent.
